使用條款｜Picsy

1. 接受條款

Picsy（以下稱本 App）由 Charonyu（App Store 賣家名稱：Cheng Yu Chiang，臺灣）開發與提供。下載或使用本 App 即表示你同意本條款。本條款補充 Apple 的標準授權合約（Licensed Application End User License Agreement）；兩者不一致時，於法律允許範圍內以 Apple 標準授權合約為準。如果你不同意，請勿使用本 App。

2. 服務內容

本 App 讓你選擇照片、Live Photo 與影片，套用模板製作照片拼貼與回憶影片，並可編輯文字、順序、比例、背景、貼紙與音樂，儲存到相簿或分享。App 也提供回憶建議、回憶提醒，以及作品的備份與還原。素材與作品都在你的裝置上處理與保存。我們可能新增、調整或移除模板與功能。

3. 帳號

本 App 不需要註冊帳號。作品只保存在你的裝置上，不會同步到其他裝置；換手機前請使用「匯出完整備份」或把成品儲存到相簿。

4. 免費功能與 Picsy Pro

免費模板、編輯與標準畫質匯出可免費使用。
Picsy Pro 解鎖 Pro 電影感影片模板、高畫質匯出（照片 2160px、影片 1080p）、自訂紙張顏色與支持者限定模板。Pro 模板可以免費預覽與編輯，匯出時需要 Pro。
Picsy Pro 提供兩種方案：
- 月訂閱： 自動續訂。費用在確認購買時及每次續訂時從你的 Apple 帳號收取；除非在目前週期結束前至少 24 小時關閉自動續訂，否則會自動續訂。若提供免費試用，試用期間取消不會收費；試用中購買訂閱時，未使用的試用期將作廢。
- 永久買斷： 一次性購買，不會自動續訂，並包含之後推出的新 Pro 模板。
價格以 App 內與 Apple 購買確認畫面顯示為準，可能因地區而異。
你可以隨時在裝置的「設定」>「Apple 帳號」>「訂閱項目」，或 App 內的「管理訂閱」管理或取消訂閱；取消會在目前計費期結束時生效。若你在訂閱期間改買永久版，請記得另外取消月訂閱。
先前購買「支持 Moments・永久升級」的使用者，仍保有高畫質匯出、自訂紙張顏色與支持者限定模板；此項目已不再販售。
付款、退款與交易由 Apple 處理，退款請依 Apple 的退款政策與流程申請。若 Apple 退款或撤銷購買，相關付費功能會停用，已完成的作品與免費功能不受影響。
使用同一個 Apple 帳號，可在購買頁「恢復購買」。

5. 你的內容

你選擇的照片、影片與製作的作品都屬於你。請只使用你有權使用的素材，並尊重他人的著作權、肖像權與隱私；分享作品前，請確認已取得畫面中人物的同意。你需對自己分享的作品負責。

6. 內建素材與授權

本 App 的模板、版型、貼紙、紙張材質、示範素材、內建配樂與音效為開發者製作。你可以把以本 App 製作、含有這些內建素材的作品儲存與分享（包括發布到社群平台），但不得把內建素材單獨抽出、散布、販售，或作為其他作品或產品的素材。
手寫日記使用的中文字型「辰宇落雁體」依 SIL Open Font License 授權隨 App 提供，授權全文附於 App 中。

7. 禁止行為

你同意不會：

對 App 進行逆向工程、反編譯或反組譯（法律明確允許者除外）
將 App 用於違法目的，或製作、散布侵害他人權利的內容
企圖規避購買機制
重新散布或轉售 App 或其內建素材

8. 免責聲明

本 App 依「現狀」提供。在法律允許的範圍內，我們不保證 App 完全沒有錯誤或中斷。作品與匯入素材只存在你的裝置上，請定期把重要作品儲存到相簿或匯出備份。

9. 責任限制

在適用法律允許的最大範圍內，對於因使用或無法使用本 App 所生的間接、附帶、特殊或後果性損害（包括作品或資料遺失），我們不負賠償責任。法律不允許排除或限制的責任，不受本條影響。

10. 條款變更

我們可能更新本條款，並更新本頁日期。更新後繼續使用即表示同意新條款。

11. 準據法與管轄

本條款受中華民國（臺灣）法律管轄並據此解釋。因本條款所生爭議，雙方同意以臺灣臺北地方法院為第一審管轄法院，但不影響你依所在地強制性法律享有的權利。

1. Acceptance

Picsy (“the App”) is developed and provided by Charonyu (App Store seller: Cheng Yu Chiang, Taiwan). By downloading or using the App you agree to these terms. These terms supplement Apple’s Licensed Application End User License Agreement (Standard EULA); where they conflict, the Standard EULA prevails to the extent permitted by law. If you do not agree, please do not use the App.

2. The Service

The App lets you choose photos, Live Photos and videos, apply templates to make photo collages and memory videos, edit text, order, ratio, background, stickers and music, and save or share the results. It also offers memory suggestions, memory reminders, and backup and restore of your creations. Media and creations are processed and stored on your device. We may add, change or remove templates and features.

3. Accounts

No account is required. Creations are stored only on your device and do not sync to other devices; before switching phones, use “Export full backup” or save outputs to Photos.

4. Free Features and Picsy Pro

Free templates, editing and standard-quality export are free to use.
Picsy Pro unlocks Pro cinematic video templates, high-quality export (2160px photos, 1080p video), custom paper colours and supporter-exclusive templates. Pro templates can be previewed and edited for free; exporting them requires Pro.
Picsy Pro is offered in two ways:
- Monthly subscription: Renews automatically. Payment is charged to your Apple Account at confirmation of purchase and at each renewal; it renews unless auto-renew is turned off at least 24 hours before the end of the current period. If a free trial is offered, cancelling during the trial costs nothing; purchasing a subscription during a trial forfeits the unused portion of the trial.
- Lifetime: A one-time purchase that does not renew and includes future Pro templates.
Prices are shown in the App and on Apple’s purchase confirmation and may vary by region.
You can manage or cancel your subscription at any time in Settings > Apple Account > Subscriptions or via “Manage Subscription” in the App; cancellation takes effect at the end of the current billing period. If you buy Lifetime while subscribed, remember to cancel the monthly subscription separately.
Users who previously bought “Support Moments · Lifetime Upgrade” keep high-quality export, custom paper colours and supporter-exclusive templates; this item is no longer sold.
Payment, refunds and transactions are handled by Apple; refunds follow Apple’s refund policy and process. If Apple refunds or revokes a purchase, the related paid features are disabled; finished creations and free features are not affected.
Use “Restore Purchases” on the purchase screen with the same Apple Account.

5. Your Content

The photos and videos you choose and the creations you make belong to you. Only use media you have the right to use, and respect others’ copyright, likeness and privacy; get consent from the people in your creations before sharing. You are responsible for what you share.

6. Built-in Assets and Licenses

The App’s templates, layouts, stickers, paper textures, sample media, built-in music and sound effects are made by the developer. You may save and share creations made with the App that contain these built-in assets (including posting them on social media), but you may not extract, distribute or sell the built-in assets on their own, or use them in other works or products.
The Chinese handwriting font “ChenYuluoyan” is included under the SIL Open Font License; the full license is bundled with the App.

7. Prohibited Uses

You agree not to:

Reverse engineer, decompile or disassemble the App (except where the law expressly permits)
Use the App for unlawful purposes or to create or distribute content that infringes others’ rights
Attempt to circumvent purchase mechanisms
Redistribute or resell the App or its built-in assets

8. Disclaimer

The App is provided “as is”. To the extent permitted by law, we do not guarantee that the App is error-free or uninterrupted. Creations and imported media exist only on your device, so please save important creations to Photos or export a backup regularly.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages (including loss of creations or data) arising from the use of or inability to use the App. Nothing in these terms excludes liability that cannot be excluded by law.

10. Changes

We may update these terms and will update the date on this page. Continued use means you accept the updated terms.

11. Governing Law and Jurisdiction

These terms are governed by the laws of Taiwan (R.O.C.). The Taiwan Taipei District Court shall be the court of first instance for disputes arising from these terms, without affecting any mandatory rights you have under the laws where you live.
