使用條款｜Lumee

1. 條款接受

下載、安裝或使用 Lumee（以下稱「本 App」）即表示您同意受本使用條款約束。本條款補充 Apple 的標準授權合約（Licensed Application End User License Agreement）；兩者不一致時，於法律允許範圍內以 Apple 標準授權合約為準。如果您不同意，請勿使用本 App。

2. 服務說明

Lumee 是一款主畫面 Widget App，讓您以不同風格打造個人化的 Widget。目前提供的工具包括：照片回憶、重要日子、天氣、日曆、世界時鐘、每日一句、步數、喝水、睡眠、組間休息、待辦事項、載具條碼、匯率、星座運勢與國際新聞（BBC）。我們可能新增、調整或移除功能。

本 App 不需要註冊帳號。

3. Lumee Pro

3.1 一次買斷

Lumee Pro 是一次性購買的非消耗型 App 內購買項目，不會自動續訂。購買後可解鎖目前所有風格，以及之後推出的新風格與 Pro 功能。

價格： 以 App 內與 Apple 購買確認畫面顯示的價格為準，可能因地區而異（台灣目前為 NT$120）。
付款與退款： 付款由您的 Apple 帳號支付，並由 Apple 處理。退款請依 Apple 的退款政策與流程申請。
恢復購買： 使用同一個 Apple 帳號，可在購買頁點「恢復購買」重新取得 Pro。
兌換代碼： 「我的」頁面中的「兌換代碼」使用 Apple 的優惠代碼機制，適用 Apple 的相關條款。

3.2 舊版月訂閱

Lumee 先前提供的 Pro 月訂閱已停止販售。既有訂閱在有效期間內仍享有 Pro。舊訂閱會依 Apple 的規則自動續訂，直到您取消為止；您可以在裝置的「設定」>「Apple 帳號」>「訂閱項目」管理或取消。若您改買一次買斷版本，請記得另外取消舊訂閱，以免持續扣款。

3.3 免費功能

未購買 Pro 時，您仍可使用免費風格與工具。我們會盡力維持已購買的 Pro 權益，但風格與功能的內容可能隨版本調整。

4. 資訊類內容

天氣、匯率與新聞資料來自第三方服務（Apple WeatherKit、Open-Meteo、open.er-api.com、BBC），可能延遲或不準確，僅供參考；匯率不應作為交易依據。
新聞標題與文章屬於 BBC 所有，點選後會開啟 BBC 網站，適用其使用條款。
星座運勢與每日一句僅供娛樂與參考。
步數與睡眠資料讀取自 Apple「健康」，僅供個人參考，不構成醫療建議。
載具條碼依您輸入的號碼產生，請自行確認號碼正確。

5. 使用者內容

您保留在 App 中使用的照片、文字與設定的所有權。您授權本 App 僅為在 Widget 中顯示的目的處理這些內容。我們不會將您的照片上傳到我們的伺服器。請只使用您有權使用的照片與內容。

6. 智慧財產權

Lumee 中的所有風格、插圖、貼圖、圖示與其他創意素材均為 Lumee 或其授權方的智慧財產。您不得在 App 外複製、散布或創作這些素材的衍生作品。

7. 禁止行為

您同意不會：

對 App 進行逆向工程、反編譯或反組譯（法律明確允許者除外）
將 App 用於任何非法目的
企圖規避購買機制或干擾我們的伺服器
重新散布或轉售 App 中的任何內容

8. 免責聲明

本 App 以「現況」和「可用」的狀態提供，在法律允許的範圍內不提供任何明示或暗示的保證。Widget 的更新時間由 iOS 決定，我們不保證 App 或 Widget 將不中斷、即時或無錯誤。

9. 責任限制

在適用法律允許的最大範圍內，我們不對因您使用 App 而產生的任何間接、附帶、特殊、後果性或懲罰性損害負責，包括但不限於資料或利潤的損失。法律不允許排除或限制的責任，不受本條影響。

10. 條款變更

我們可能修改本使用條款，並更新本頁日期；如有重大變更，會在適當情況下於 App 內通知。在變更發布後繼續使用 App 即表示接受修訂後的條款。

11. 準據法與管轄

本使用條款受中華民國（臺灣）法律管轄並據此解釋，不考慮法律衝突條款。因本條款所生爭議，雙方同意以臺灣臺北地方法院為第一審管轄法院，但不影響您依所在地強制性法律享有的權利。

1. Acceptance of Terms

By downloading, installing, or using Lumee (“the App”), you agree to be bound by these Terms of Use. These terms supplement Apple’s Licensed Application End User License Agreement (Standard EULA); where they conflict, the Standard EULA prevails to the extent permitted by law. If you do not agree, please do not use the App.

2. Description of Service

Lumee is a home-screen widget app that lets you build personalized widgets in different styles. Current tools include photo memories, important days, weather, calendar, world clock, daily quote, steps, water, sleep, rest timer, to-dos, invoice carrier barcode, exchange rates, horoscope and world news (BBC). We may add, change or remove features.

No account is required.

3. Lumee Pro

3.1 One-Time Purchase

Lumee Pro is a one-time, non-consumable in-app purchase and does not renew. It unlocks all current styles and future new styles and Pro features.

Price: As shown in the App and on Apple’s purchase confirmation; it may vary by region (currently NT$120 in Taiwan).
Payment and refunds: Payment is charged to your Apple Account and processed by Apple. Refunds follow Apple’s refund policy and process.
Restore: Tap “Restore Purchases” on the purchase screen while signed in with the same Apple Account.
Offer codes: “Redeem Code” on the Me page uses Apple’s offer code system, and Apple’s terms apply.

3.2 Legacy Monthly Subscription

The Pro monthly subscription Lumee previously offered is no longer sold. Existing subscribers keep Pro while their subscription is active. A legacy subscription keeps renewing under Apple’s rules until you cancel it in Settings > Apple Account > Subscriptions. If you switch to the one-time purchase, remember to cancel the old subscription to stop further charges.

3.3 Free Features

Without Pro, you can still use the free styles and tools. We aim to preserve purchased Pro benefits, but the set of styles and features may change between versions.

4. Informational Content

Weather, exchange rate and news data come from third-party services (Apple WeatherKit, Open-Meteo, open.er-api.com, BBC), may be delayed or inaccurate, and are for reference only; exchange rates should not be relied on for transactions.
News headlines and articles belong to the BBC; tapping one opens the BBC website, whose terms apply.
Horoscope readings and daily quotes are for entertainment and reference only.
Step and sleep data is read from Apple Health for personal reference only and is not medical advice.
The invoice carrier barcode is generated from the code you enter; please make sure it is correct.

5. User Content

You retain ownership of the photos, text and settings you use in the App. You allow the App to process this content solely to display it in your widgets. We do not upload your photos to our servers. Please use only photos and content you have the right to use.

6. Intellectual Property

All styles, illustrations, stickers, icons and other creative assets in Lumee are the intellectual property of Lumee or its licensors. You may not reproduce, distribute, or create derivative works from these assets outside of the App.

7. Prohibited Uses

You agree not to:

Reverse engineer, decompile, or disassemble the App (except where the law expressly permits)
Use the App for any unlawful purpose
Attempt to circumvent purchase mechanisms or interfere with our servers
Redistribute or resell any content from the App

8. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, to the extent permitted by law. Widget refresh timing is controlled by iOS, and we do not guarantee that the App or widgets will be uninterrupted, real-time, or error-free.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data or profits. Nothing in these terms excludes liability that cannot be excluded by law.

10. Changes to Terms

We may modify these Terms of Use and will update the date on this page; for material changes we will notify you in the App where appropriate. Your continued use of the App after changes are posted constitutes acceptance of the revised terms.

11. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of Taiwan (R.O.C.), without regard to conflict of law provisions. The Taiwan Taipei District Court shall be the court of first instance for disputes arising from these terms, without affecting any mandatory rights you have under the laws where you live.
